New product liability law comes into force in Thailand
Thailannd's new Unsafe Product Liability Act, the country's first such law, came into effect on 20 February 2009. Defining the scope of responsibility governing product safety and shifting the burden of proof to manufacturers and importers, the Act enforces legistration for the first time to incriminate Thai manufacturers for their defective products, and grant punitive damages to injured parties as a result of poor product manufacture, incorrect instructions for use and improper accountability.
If an injury is sustained because a product was determined unsafe, the new Act entitles the user to file a suit for damages against the manufacturer or importer of the product and prevents manufacturers and importers from working out alternative agreements with consumers to disclaim or limit their liability. It also allows product retailers to be held liable under the same terms if they are unable to identify the particular manufacturer or importer.
With the Act in place, manufacturers and importers must examine their manufacturing and import processes to ensure full compliance with product specifications and labelling. Similarly, retailers should ensure that they can identify the manufacturer or importer of all the goods they sell. If sellers have because of some conduct on their part, caused the injury, the manufacturer or importer could also take reverse action against them.
